CaterZen provides call recording functionality through integrations with third-party telecommunications providers, such as Twilio. Call recording, monitoring, and storage are subject to applicable local, state/provincial, federal, and international laws, which may vary based on the location of each participant.
You are solely responsible for determining and complying with all applicable laws before recording or monitoring any call.
Call recording laws generally fall into two categories:
One-Party Consent
In some jurisdictions, only one participant in the conversation must consent to the recording. If you are a participant, your consent may be sufficient.
All-Party (Two-Party) Consent
In other jurisdictions, all participants must be informed of and, where required, provide affirmative consent before recording begins.
Notification alone may not satisfy legal requirements in all jurisdictions. You are responsible for determining when consent must be explicit.
Calls involving participants in different states or countries may be subject to multiple legal frameworks.
You should assume that the most restrictive applicable law may apply. For example:
If any participant is located in a jurisdiction requiring all-party consent, you may need consent from all participants.
International calls may be subject to additional privacy, data protection, or telecommunications regulations.
To reduce compliance risk, CaterZen recommends providing clear notice and obtaining consent from all participants before recording any call, regardless of jurisdiction.
Your Responsibilities
By enabling or using call recording features, you acknowledge and agree that:
You are solely responsible for complying with all applicable call recording, monitoring, privacy, and data protection laws.
You will provide any required notice and obtain any required consent prior to recording
You are responsible for how recordings are collected, stored, accessed, shared, and deleted.
You will monitor and update your practices as laws change.
You are responsible for configuring any third-party services (including Twilio) in a compliant manner.
CaterZen may offer features that attempt to assist with compliance, such as automatically enabling or disabling recording based on phone number data (e.g., area codes).
These features have significant limitations and may be inaccurate. For example:
Mobile numbers may not reflect a user’s current location.
VoIP or virtual numbers may not correspond to a physical jurisdiction.
Numbers may be ported between regions.
Calls may be made while participants are traveling.
International routing and forwarding may obscure actual location
CaterZen does not represent or warrant that these features will determine legal requirements or ensure compliance. You should not rely on them to make compliance decisions.
To support compliant use of call recording, consider:
Playing a recorded announcement before the call is connected.
Using text-to-speech or uploaded audio greetings.
Providing verbal notice at the start of the call.
Confirming consent when required by applicable law.
Allowing participants to opt out of recording where necessary.
Training employees on applicable legal requirements.
Example notification:
“This call may be recorded for training, quality assurance, and customer service purposes.”
Additional or more explicit consent language may be required depending on jurisdiction.
CaterZen does not provide legal advice and makes no representation or warranty that its features will ensure compliance with any law or regulation.
You are solely responsible for your use of call recording and monitoring features and for compliance with all applicable laws, including those related to consent, privacy, data protection, and telecommunications.
CaterZen is not liable for your use of these features or for any failure to comply with applicable laws. If you have questions about your legal obligations, you should consult a qualified attorney familiar with the relevant laws in your jurisdiction.
